Braintree is among the Massachusetts towns and cities that proposes limit where the medical marijuana dispensaries can be located.
When state voters approve something through a referendum, individual towns can't prohibit it. That's the gist of a state Attorney General's Office ruling, which strikes down bans on medical marijuana facilities, as conflicting with state law. In November, state voters overwhelmingly approved a ballot referendum that allowed medical marijuana treatment facilities and dispensaries. Attorney General Martha Coakley's decision came in a review of a bylaw approved in Wakefield. Towns are able to adopt zoning bylaws that will regulate the treatment centers, as well as enact temporary moratoriums on development of the centers, according to the Attorney General's Office. The Braintree Town Council will again take up the request by Scott Palmer to change his property from Residence B to General Business on Oct. 16.
Officially, the Town Council on Tuesday examined a request by Braintree resident Scott Palmer to re-zone his land off Independence Avenue to General Business. But the real focus of the night settled on a less tangible idea: the future. What might the long-blighted property look like if the zoning change is approved and re-development comes? Braintree councilors recommended favorable action on the measure that could lead to a mixed-use development at 7-11 Independence Ave.
A Town Council subcommittee recommended favorable action this week on a proposal to re-zone 7-11 Independence Ave. to make way for the sale of the property to a developer. The positive vote came after several delays by the Committee on Ordinance & Rules, which tabled the measure in May over concerns about taxes, environmental problems and who owns a key private way bordering Braintree and Quincy. Scott Palmer inherited the property after his father Robert passed away in 2001 and has been negotiating with developer Thomas Fitzgerald, who plans to build a combination residential and commercial space on the currently unused property, Palmer's attorney John Garland said.
