OUI After Braintree Man Gets in Accident at T.G.I. Friday's

A 43-year-old Braintree man was arrested and charged with operating under the influence of alcohol last Wednesday, May 30 after he was allegedly drunk and involved in a minor car accident.
Police responded to T.G.I. Friday's on Wednesday evening and found that Scott W. Alden had been in the accident while pulling out of a parking space, Deputy Chief Russell Jenkins said in a statement.
"While speaking with Alden, Officer Brian Eng detected a strong odor of alcohol on his breath and made other observations of possible intoxication,"
He was arrested after performing several sobriety tests and at the police station recorded a blood alcohol level almost twice the legal limit of 0.08 percent, Jenkins said.

I'm also curious about this. My friend is a lawyer (http://www.leojdunnlaw.com/quincy-ma-personal-injury-lawyer/) and has dealt with over-serving cases, but I don't know what the implications would be if they are held liable. Does anyone know the answer to this?
